Niy the Overseer OTD

Got tired of waiting for Midar to spawn so went to try and get some OTD's. Got the Guardian Bow, but when I killed Niy the Overseer he didn't drop his sword.

I killed him twice and no drop except for coin. I searched and it looks like it was noted in some forum posts from 2009. But i'm guessing it hasn't been implemented yet. Or, is there a particular reason it may not have dropped?

Only Chars able to wield 2-H receive the otd-sword
